What Is Expedited Trademark Examination — and How Does It Work?

Standard trademark registration in India follows a defined process: Form TM-A is filed on ipindiaonline.gov.in, and the application enters a queue for examination by the Trade Marks Registry (CGPDTM). In 2026, this examination step typically takes 4 to 6 months from the date of filing — the period during which the Examiner reviews the application for Section 9 (absolute grounds) and Section 11 (relative grounds) objections.

The expedited trademark examination process allows an applicant to request priority examination by filing Form TM-M alongside Form TM-A at the time of the original application. Under Rule 41A of the Trade Marks Rules, 2017, the Trade Marks Examiner is required to issue the Examination Report within 30 days of the date of the expedited application — compared to the standard 4–6 month wait.

🏛️Legal Basis: Rule 41A, Trade Marks Rules, 2017 — “Where a request for expedited examination has been filed in Form TM-M along with the prescribed fee, the Examiner of Trade Marks shall examine the application within thirty days from the date of such request and thereafter proceed in accordance with the Act.” Form TM-M must be filed simultaneously with Form TM-A — it cannot be added to an existing application after filing.

⚠️ Critical — Form TM-M Must Be Filed With TM-A

Form TM-M cannot be filed after your trademark application has already been submitted. If you have already filed Form TM-A without Form TM-M, the only option is to file a new application with both forms together — which means a new filing date and a new government fee. If you need expedited examination, confirm this before filing. Trademark Registration by TNP assesses expedited eligibility at the free consultation and files both forms simultaneously where required — call 77589 38424.
