What Is Patent Registration in India — and What Does It Protect?
A patent is a legal right granted by the Government of India that gives the patent holder exclusive rights to make, use, sell, and import their invention in India for 20 years from the date of filing. In exchange for this monopoly, the inventor publicly discloses how the invention works — contributing knowledge to the public domain after the patent expires.
Patents in India are governed by the Patents Act, 1970 and the Patents Rules, 2003 (as amended, most recently by the Patents (Amendment) Rules, 2024), administered by the Indian Patent Office (IPO) under the Controller General of Patents, Designs and Trade Marks (CGPDTM). The IPO maintains offices in Mumbai, Delhi, Kolkata, and Chennai.

Patent costs in India depend on the applicant's category, number of claims, number of pages in the specification, and whether early publication or expedited examination is chosen. Drafting & Filing Complete Specification (Form 1 + Form 2)

Publication of Application
After 18 months from the filing date (or priority date), the application is automatically published in the Official Journal of the Indian Patent Office — making it publicly available. Early Publication (Form 9) can be requested to publish sooner (fee: ₹2,500 for MSME/startup). From publication date, the applicant has provisional protection — infringers can be held liable from this date if the patent is subsequently granted.

Request for Examination (Form 18 or 18A)
The patent is NOT examined automatically — you must file a Request for Examination (Form 18) within 48 months of the filing/priority date. Without this, the application is treated as withdrawn. Fee: ₹4,000 (MSME/startup) or ₹20,000 (large entity). Startups are eligible for expedited examination under Rule 24C of the Patent Rules — significantly reducing examination time.

Examination & First Examination Report (FER)
A Patent Examiner reviews the application and issues a First Examination Report (FER) — raising objections on novelty, inventive step, or other grounds. You have 12 months from the FER date to file a written response with counter-arguments and amended claims. Multiple rounds of exchange between the applicant and Examiner (prosecution) may follow until the objections are resolved.

Grant of Patent
Once all objections are overcome and the Examiner is satisfied, the patent is granted and recorded in the Indian Patent Register. The Patent Certificate is issued. From this date, you have full enforcement rights — you can sue infringers for damages and injunctions in court. Patent protection runs for 20 years from the filing date of the complete specification.

Annual Renewal Fees (from 3rd Year)
A granted patent must be maintained by paying annual renewal fees starting from the 3rd year. Renewal fees increase progressively each year. Failure to pay renewal fees causes the patent to lapse. For MSMEs and individuals, renewal fees range from ₹800 (3rd year) to ₹4,800 (20th year). Lapsed patents can be restored within 18 months of lapse on payment of restoration fee.

What Is Design Registration — and How Is It Different From a Patent?
Design registration in India is the legal process of securing exclusive ownership over the unique visual appearance of a product — its shape, configuration, pattern, ornamentation, or composition of lines and colours — under the Designs Act, 2000. Once registered, no competitor can legally copy, imitate, or sell a product with the same or deceptively similar appearance without your consent.
The key distinction from a patent: design registration protects HOW a product LOOKS — not how it WORKS. If you invent a uniquely shaped water bottle, the shape is a design (protect it under the Designs Act). The mechanism that keeps water cold is the invention (protect it with a patent). The brand name printed on it is a trademark.
The registration is granted by the Office of the Controller General of Patents, Designs & Trade Marks (CGPDTM) and follows a first-to-file principle — meaning whoever files first gets priority, regardless of who created it first. This makes early filing critical for Vasai and Mira Road product manufacturers.
💡 Design Registration Is a Tax Asset
A registered design qualifies as an intangible asset under Section 32(1)(ii) of the Income Tax Act, 1961, eligible for 25% depreciation on written-down value. A registered design is protected for 10 years from the date of registration under Section 11 of the Designs Act, 2000. You can extend this protection once for 5 years, making the maximum term 15 years. To maintain protection, file Form-3 before the initial 10-year term expires. If the registration lapses, you can apply for restoration by filing Form-4 within 12 months of its expiry.

Novelty Check & Prior Design Search
Before preparing the application, search the Indian Register of Designs through the IP India portal and the WIPO Global Design Database. The purpose is to identify whether a substantially similar design already exists in the registered class. A design must be new and original — not previously registered, published, or used anywhere in the world before the filing date.

Prepare Design Representations
The design must be represented through clear drawings, photographs, or computer-generated images showing the design from multiple views (front, back, side, top, perspective). The design must appeal to and be judged solely by the eye. The representations must clearly show the visual features — shape, configuration, pattern, or ornamentation — that are claimed as the design.

Classify Under Locarno Classification
India's design registration system uses the Locarno Classification system — an international framework that classifies industrial designs into 32 classes and 211 subclasses based on the article to which the design is applied. Filed online at ipindiaonline.gov.in. Design registration costs ₹1,000 for startups and natural persons or ₹4,000 for other applicants. Physical filing is accepted at any of the four Patent Offices in Delhi, Mumbai, Chennai, or Kolkata. All substantive examination and prosecution is conducted only at the Designs Wing in Kolkata. E-filing is recommended — faster and lower cost.

Examination by Design Examiner
After filing, the application is assigned to a Design Examiner at the CGPDTM office. The Examiner reviews novelty, originality, Locarno classification, and whether the design qualifies under the Designs Act. If objections are raised, you receive an Examination Report and must respond within the specified time.

Registration Certificate Issued
On successful examination, the design is registered and entered in the Register of Designs. The Registration Certificate is issued. The date of registration is the date of application. From this date you have exclusive rights — competitors cannot manufacture, sell, or import any article bearing the same or deceptively similar design in India.
